Agreement to Terms
By accessing or using Vivian (“the Service”), operated by TinyOrange, you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
Description of Service
Vivian is a photography portfolio platform that allows photographers to:
- Connect their Google Drive to sync and display photos
- Create and customise online portfolio galleries
- Share their work publicly or privately
Account Registration
To use Vivian, you must:
- Sign in using a valid Google account
- Be at least 13 years of age
- Provide accurate and complete information
- Maintain the security of your account credentials
You are responsible for all activity that occurs under your account.
Acceptable Use
You agree NOT to:
- Upload or display content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Infringe on intellectual property rights of others
- Upload content depicting minors inappropriately
- Attempt to gain unauthorised access to the Service or its systems
- Use the Service for any unlawful purpose
- Interfere with or disrupt the Service
- Circumvent any security measures
Your Content
Ownership
You retain full ownership of all photos, images, and content you upload or sync through Vivian. We do not claim any ownership rights to your content.
Licence
By using Vivian, you grant us a limited licence to:
- Store and display your content as part of the Service
- Create thumbnails and optimised versions for display
- Cache content for performance purposes
This licence ends when you delete your content or account.
Responsibility
You are solely responsible for:
- Ensuring you have the right to display all content in your portfolio
- The accuracy and legality of your content
- Obtaining necessary permissions for photos of identifiable individuals
Google Drive Integration
By connecting your Google Drive:
- You authorise Vivian to access folders you select (read-only)
- You can revoke this access at any time via your Google Account
- We will only access content you explicitly choose to sync
Intellectual Property
The Vivian service, including its design, features, and branding, is owned by TinyOrange and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.
Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms.
Service Availability
We strive to maintain reliable service, but:
- The Service is provided “as is” without warranties
- We may modify, suspend, or discontinue features at any time
- We do not guarantee uninterrupted or error-free service
- Scheduled maintenance may cause temporary unavailability
Limitation of Liability
To the maximum extent permitted by law:
- TinyOrange shall not be liable for any indirect, incidental, special, or consequential damages
- Our total liability shall not exceed the amount you paid for the Service (if any)
- We are not liable for loss of data, though we take reasonable measures to protect it
Indemnification
You agree to indemnify and hold harmless TinyOrange from any claims, damages, or expenses arising from:
- Your use of the Service
- Your content
- Your violation of these Terms
- Your violation of any third-party rights
Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Abuse the Service or its users
You may delete your account at any time through your account settings.
Changes to Terms
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of significant changes.
Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in effect.
